The 2025 Advertising Law and what it means for digital advertising businesses (SJK Ads)

The Law amending and supplementing a number of articles of the Advertising Law, No. 75/2025/QH15, was passed by the National Assembly on 16/6/2025 and is in force from 01/01/2026. Most of what is new concerns online advertising and influencers; this article sums up what touches boards, banners and outdoor screens. The article numbers below are those of the Advertising Law as amended.

Advertising screens (Article 28)

  • Screens must be placed under the Law, the technical regulation on outdoor advertising structures and the province's outdoor advertising plan.
  • Outdoor screens: no sound; their light must not affect road safety.
  • The owner or lawful user of a screen must take technical measures against cyber attacks and keep the screen's information secure.
  • Network-connected screens are managed under rules issued by the Government.

For buyers: content for outdoor screens must work without sound and avoid harsh flashing.

Notifying advertising products on boards and banners (Article 30)

Anyone who wants to advertise on a board or a banner files a notification of the advertising product with the province's advertising authority before it goes up.

Transition: notifications filed before 01/01/2026 that the authority had not yet answered are handled under the old law (Article 3 of Law 75/2025/QH15).

Duties of the advertising structure's owner (Article 31, new clause 5)

The owner of an advertising structure is responsible for the structure's quality, safety and fire prevention for signs and boards; must repair or replace boards and screens, or remove advertising products when they are damaged or the advertising contract ends; and must compensate any damage caused.

For owners: keep maintenance and inspection records; contracts with buyers should state who removes the content when the term ends.

Outdoor advertising plans (Articles 37, 38)

  • Plans set the style, size, materials and number of advertising structures along roads, in cities and in city centres.
  • Plans must keep the locations already used for advertising in line with current rules; if a new plan causes loss to an organisation or person, the authority that approved the plan arranges compensation.
  • The provincial People's Committee draws up, adjusts, approves and publishes the plan; the Ministry of Construction issues the technical regulation on outdoor advertising structures.

Other points worth knowing

  • Loudspeakers mounted on vehicles and other moving means may not be used for advertising in cities (Article 33).
  • Organising a group of people to advertise (a roadshow) requires filing a notification with the province's authority beforehand (Article 36).
  • Advertising content must be truthful, accurate and clear, and must not mislead (Article 19); influencers who take part in advertising have their own duties (Article 15a).

What WikiOOH does

On WikiOOH, board owners are legally responsible for their boards; the marketplace's rules are on the Operating rules page. When you get a quote, ask the owner about the construction permit and how long the notification to the province takes, so the campaign schedule is right.
